engineers is digging. they still are occasionally digging here and there and they were digging in a pit in this house on the 4800 block of glenn broom road here in spring valley when they a glass frack. it was nun unstoppered frack with a solid substance. it was taken to the edgewood arsenal where it was indicated it was mustard, a chemical agent used to make mustard gas during world war i. so the army said they had an air monitor at that site and that was not activated so they think there was no danger to the public when this flask was recovered, analyzed and then removed from the area. of course this whole neighborhood, sprinvalley, used to be rural land, owned by american university, which turned it over to the army for years of am munition and testing and some of the houses here have been abandoned, including the one behind me. so the army says they are going

to evaluate the safety procedures used on this site before they go back to digging in front of this home. meanwhile, neighbors and the advisory neighborhood commissioner who live around here are not happy at this most recent discovery. >> i'm very disappointing. i had hoped that what we had been told by the army corp now, that the site was relatively clean and ready to be shut down in terms of cleanup, we now find out that's not the case at all. >> reporter: we have been covering this story at fox 5 for more than ten years and apparently it will go on a while longer because they keep finding dangerous chemicals and sometimes munition in the spring valley neighborhood. eleanor homes norton will meet with the army later today and try to encourage them to stay here until everything is

cleaned up. claudia. >> thank you uatpde update on that. d.c. investigators are back in fort washington searching for the remains of shakita bell. last year her boyfriend michael dickerson admitted he killed her back in 1996. he promised to lead police to her body in exchange for a sentence of 15 years. so far he hasn't been able to point out that location. the hunt for a missing d.c. mother may be over. tiffany holsey disappeared nearly 3 weeks ago. over the weekend a body was founin a wooded area off m. street a block from where her father lives. they say the victim was wearing the same type of clothes and had the same tattoo. so far officials have not released an official cause of death or id. and now more on the pit bull attack this week. on

carter delanie was found dead inside a home next to the remains of a small dog. he had been malled to death. the man convicted of terrorizing elderly women will be sentenced for 14 charges, including first-degree murder. he hog tied and bound four women in montgomery county between september of 2007 and september of 2008. one victim died from injuries. prosecutors are pushing for life without the possibility of parole. federal officials investigating metro crashes in june are backing off about when they learned of previous problems. according to the washington post, the ntsb said they first learned about problems last week but now a metro employee

says they spoke about a emergency brake to avoid hitting another train previously. [ chanting ] more town hall showdowns. ben carden got another earful about the president health care reform in hagerstown last night. carden took 25 questions. fears of government take over dominated during the takeover. the number of u.s. households on the brink of foreclosure rose 7% from june to july. that's according to realty track. it reports one in every 355 homes received a foreclosure related notice. that's the highest monthly level since the realty track began publishing the data me than four years ago. the time now is 7 minutes after the hour. there is a new push to bring back the check points in the neighborhood. we'll talk with the mayor about that when he joins us next.

option for crime fighting and they worked well. granted you don't want to use them because it means the crime is out of control in a particular neighborhood, but remember, we had like a triple homicide in trinidad and then there was maybe four others in one month. we haven't had anything like that in a neighborhood since, but if we do, the attorney general is saying let's keep it as a tool. >> do you think he has the means to fight that and get them back? do you think it's a winning battle there? >> i think from a public safety standpoint, no question. >> legally though? >> it's being battled in the courts. one court rules for us, another one ruled for the plaintiff. but the citizens need relief. >> the u.s. court of appeals stern in the wording condemning these and peter nichols wants to find a more creative way for dealing with this. there another option out there than doing it the way it was done last year?

>> well i think whenever you're open-minded and you have a cingular goal, which is to reduce crime, i think we can reduce the crime. i can appreciate what the attorney general is saying. we won't say there is nothing we can do, we'll find another way. everyone knows where the drug dealers are and where the gangs are. so let's go in and get them. and the check points were one way of doing that. >> do you feel strong enough that you could take to the supreme court. and you could, but would you? >> i would have to consult legal to get the anson that. but we'll take it as high as we need to and can, because it made a really big impact on crime in the trinidad area. in fact the 5th district along with most of the homicide and violent crimes down this year. >> and i know you're a big fan about communicating with other cities that do this.

are other cities doing things to combat crime that you can say we can think about implementing that in our city. >> absolutely. this was bourne out of what was done in other states and cities. and i think we're most aggressive and that's what you want your chief of police to be. but we continue to look at other things done. and with the technology and the homicide closure wait and a lot are coming to chief lanyer to come and find out more practices as well. and kids going back to school soon. and we saw you at alice beale school and look at what we're looking at. >> 264 hours until the first day of school. >> but you're not counting.

>> right. now schools, savoy, we're going to do the ribbon cutting off of martin luther king avenue. and we had hd cook in ward one and one or two others that are slipping my mind, but the point is we are in the first year of allen lou's 5-year commitment to have all of the schools renovated or repaired, the beginning of the renovation and repair, modernization or rebuilding a new school. wilson high school is being redone and woodson high school. and then the chancellor has a great program in the schools. test score have gone up, we have the least amount of teacher vacancies in the school system's history. text books are all coming in and now we're just urging all of the parents to take the kids in and get their immunization shots. you have to get more shots this

year than last year. >> with h1n1. >> do you want to ke some of your e-mails. >> let's do it. >> this is regarding housing development in the kenilworth avenue area. the viewer writes, kenilworth avenue leaves many travelers and commuters into our city however the kenilworth courts housing project in d.c., pg county line and east worth avenue is crime ridden and does not reflect our wonderful city at all. when i have to pass through, i do it with reluctance and speed because i don't know if i'll be caught in a cross fire or carjacked if i slow down. here is the question. when is this housing project going to be torn down. it does not reflect well on the city. and she wants to know if there is redevelopment there after. >> that's a good question. >> is it going to be torn down? >> what we have done, our administration has followed up on my predecessor's vision of the new communities so we're not tearing anything down and

letting everybody kind of go here and there and everywhere, we're trying to rebuild new housing, much more quality housing, build some mixed income around it and we're having progress in northwest 1, lincoln heights, barry farms and others. >> so this area may be slated down the road. >> yeah. we want to get there, green leaf, as many of the public housing projects because th were never designed well, they haven't been maintained well. they are extremely substandard. in the meantime, let me put my team on it and check out what is going on there at kenilworth and eastern. both from a public safety and transportation standpoint. a lot of construction work going on in the area. so we'll report back to you. >> let's get to one more from southeast brandywine street. 700 block there. a redevelopment neighborhood. .viewer is happy. a lost new condos but with that

he is convicted of bombing a pan am flight over scotland more than 20 years ago. but sky news is reporting that the former libby an intelligent agent may be released from jail now due to his poor health. scottish justice officials say final decision was made. he was sentenced to life. all 259 people aboard that flight were killed, including 200 americans, another 11 people died on the ground. you can expect a few changes the next time you fly. starting this weekend you'll have to give your birth date and your gender when you make an airline reservation. coming up at 8:00 we'll talk

residents as a mask with the agent mustard -- a flask with mustard has turned up. the army corp of engineers found it last week in what was once a testing ground known as pit 3. it's not the first munition to turn up over the past three years but the corp says the flask did not pose a threat to the neighborhood. raise your taxes for legislation. creigh deeds told the richmond times he would sign a tax for bills. he says he does not want to move money from the state's general fund to pay for road work. it is 7:30. let's check in with tony. the temperature has held steady. >> it has held steady all morning long. 73 degrees. earlier we showed you on one of our new radar systems the fog forming out to the west.

the national weather service has issued a fog advisory for areas way out to the west. and this is the central atlantic and this is tropical depression number two. it's just a number, no name. and to be honest. it doesn't look as impressive as it did yesterday. it's lost some of the intensity. but because of the waters that it's in and the path that it's taking, it could still develop into a tropical storm. the national hurricane center is keeping their eyes on it. no development yet, but we're watching t to see how things go. if it becomes a name, itwill be anna. and temperatures around the region, 73 degrees. 72 at dulles airport. to the north and west, 66 in frederick, 63 in harrisonburg. and here is the satellite radar for our region. you can see the clouds and fog out to the west. and as it develops and grows to

are you doing your broadway tunes. >> i'll stick with our top 40. inner loop of the beltway here as you work north from braddock road past 236. caller reported an accident tieing up the two right lanes. from this particular camera angle what i see is slow traffic toward gallows ready. we had a fender-bender at gallows blocking the left lane but callers are reporting another accident here in the backup near 236 along the right side of the road. not an easy commute up the west side this morning. top side of the beltway, outer loop slowing past 95 toward georgia avenue. crash at the truck sales leaving urbana. that's a check of your fox 5 on- time traffic. secretary of state hillary clinton continuing to make headlines with her comments. she spoke about corruption and encouraged the nation to fix it's flawed elect oral system and made reference to the 2000 presidential race here in the united states. >> our democracy is still evolving.

we had all kinds of problems in some of our past elections, as you might remember. in 2000 our presidential election came down to one state where the brother of the man running for president was the governor of the state. so we have our problems too. >> earlier this week she made news with an animated answer to a students question that she had thought he asked about her husband's mmning when nghe was meaning to ask about president obama's stance. documents released by the house judiciary committee are shedding light on karl rove's firing of one u.s. attorney in 2006. harriet miers told investigators that rove was aggravated about david iglesias. he was one of nine u.s. attorneys being fired, some say for not being loyal enough to the bush administration.

it is said politics play nod role in the firing. joining us is david markie. rove says there is no political motivation at all. does this confirm that so many people thought, that this was politically motivated. >> right. whether or not this was illegal, this does play into the hands of the long time critics of the bush administration that each decision was motivated by politics and the white house political team was getting involved in places they had no place being involved in. >> and you mentioned how this could be proven to be illegal, could we see karl rove going off to jail. can they prove that? >> prosecutors would have to prove he interfered with a specific justice department investigation. that's an awfully tough decision to be made. and i haven't heard even the toughest critics make that yet.

>> there is a lot of e-mails and contacted harriet miers but there was -- there was not an exact allegation. >> there building their case until finally the trigger is pull understoody 2007. now there is other circumstantial evidence of members of congress from new mexico getting involved and saying look into this guy. the white house political team and republicans were upset that prosecutions of democrats were not being made but there is not a quid pro quo there. >> now e-mails are shedding light for those surrounding karl rove and now we' hearing that scott jennings made the effort to go out to new mexico to sit down and talk with folks. is karl rove setting up a fall guy, do you think? >> it would appear something along those lines because we are seeing mr. rove's attorney saying it was mr. jennings who

initiated it. it's not the first time that thing would happen. a couple of years ago the senate judiciary committee held hearings about there and there were other aids that were fingered in all of this. so i think mr. rove is trying to deflect some of the blame here. >> and you mentioned mr. jennings. he's issuing a comment saying he has hired an attorney saying what rove is saying is false. which we don't hear too often, a former aid going back and saying you're wrong. >> we're seeing a lot of dissension from the bush administration coming out now. this always seems to happen. it's surprising in the bush white house which for so long seemed so unified and on message. and now we're getting a bigger picture of things. >> and an even bigger picture of word cheney. and word is he'll have a tell- all. he doesn't sound too happy in some of the excerpts and i

wanted to get your thoughts because he's firing back at george bush, saying he was weak in so many ways. >> vice president cheney was never a loyal bush. he came in later. he was brought in to be a counselor to the president. he had no real vested interest in george w. bush's success. he had his own agenda. that was what was happening in the white house. clearly it's continuing now they've both left office. >> and with dick cheney, we keep seeing him more out in the public and we don't see that with the former vice president. that's not typical. you typically don't hear from the former administration commenting on current matters. >> he doesn't care. he has a sense of pollies and values that he came into office to promote and it doesn't matter who gets in front of him. he doesn't care if he has a 10% approval rating. he's willing to say what he means. >> well i have a feeling we'll be hearing more as more leaks

sense. >> it was a key historical moment if our pop culture and its with a time -- and it was a time that changed music journalism. >> and what do you mean by that? >> it was put on the music map for the first time. >> and journalists realized it was important to tell these stories and how it affected commercialism and our culture. so what will people see when they come down here? >> we have a wonderful collection of phography here in our woodstock exhibit. the woodstock exhibit didn't document itself the way you tube does. they weren't carrying cameras into the festival so we were delighted to discover this wonderful collection of photography from a very young photo journalistho was 17 years old that have never been on public display before. his name was dan gason and he was only 17, he was a high

school journalist. he got a press pass to cover it and he took more than 300 photographs and took them home and showed them around and put them in his parents house and they were forgotten until now. heied very young, at age 40 and i colleague helped us acquire these for the 40th anniversary. >> reporter: had a has been the reaction from people? >> wonderful. we see people dancing down the aisles here in the exhibit. it takes those who were of that era back and those who weren't of that era back to a time their parents talked about. >> it's a good family exhibit for people to come and experience together. you talk about taking some people back. tom haller knows what you mean. he's the senior videographer there. and first of all, let's prove you were there. show this. >> okay. this is me right here. and this is the neck of mi hendrix's guitar. this is my friend ricardo,

that's a check of your fox 5 on- time traffic. our big story this hour, them rapts of world war i hb. ing up in a ehoor od >>es neighborhood. >> now residents are questioning if their safety is at risk. crews unearth a flask containing the chemical agent of must have had ard on glenn brook road. a area familiar with munition digging there. and john henrehan joins us live with more. >> reporter: we've been covering this story for more than 10 years in upper northwest d.c. because the arpy core of engineers have been finding and sometimes individuals finding old shells and chemicals in their yard. and this is what happened yesterday. the army informed the neighborhood and media on august 4th they found what was believed to be a dangerous chemical in this yard on glennbrook road in spring valley and some of the people around here were not happy to

hear that it happened. >> did they notify the d.c. metropolitan police depament? did they notify the fire department? where was this material stored and when it went to the laboratory, how did it get there and where did it go? we're talking about mustard gas here. >> reporter: we have some of the answers to those questions. what the digers found was a glass flask that had a solid substance in the bottom, testing at edgewood arsenal in maryland discovered it was the chemical agent mustard used to make mustard gas. now the army said they had air monitors at this digging site and they were not activated so they do not believe there was a danger to the public. all of the chemicals come from the fact that nearly 100 years ago, in the world war era, this was a rulear part of d.c. and part of the american university experimental station where the army actually tested both munitions and chemicals on

e tattoo. so far police have not made a positive i.d. or released an official cause of death. the search for shakita bell picks up this morning. investigators are back in fort washington digging for clues. she disappeared in 1996, last year her boyfriend mycl bell admitted to killing here and he made a plea deal to lead police to her remains in exchange for a lighter sentence of 15 years. so far he has not pointed out that location. you might remember last year police stopped cars in the trinidad area, screening who came in or left the area to help curb crime. but last month a federal appeals court ruled the program was unconstitutional. early this morning the mayor joined us and said he's willing to take this fight as far as he can. >> i think whenever you're open- minded and you have a cingular goal, which is to reduce crime,

i think we can find a solution. i appreciate what the attorney general is saying. he's saying if the court rules against us, we're not going to say there is nothing we can do. we'll just find another way. >> in the meantime, look ahead to next year when the mayor is up for re-election. a new poll came out today, first published in the d.c. examiner and showed 30of those surveyed will vote for the mayor again last year. 13% said they would not. and 46% said they would consider other candidates. now we do have to let you know, one note about the poll, it only surveyed people in wards 1, 3 and 6 where counsel members are also up for re- election next year. when did federal investigators know about metro's march 2nd avoiding -- that nearly avoided a train crash. originally federal investigators investigating the crash in june said they were only made aware of that incident last week. bau cording to the washington post, a spokesperson for the ntsb now says a metro employee

your name as it appears on your government-issued id and gender and date of birth. but the main thing to be concerned about is tht if you're asking for it, provide it, but don't worry if you are not. it will not impede your travel. >> is this a way to track who is traveling. >> we want to use this information and match it against a government watch list to clear passengers. so the more information we have, the more ability we have to clear passengers and let them get a boarding pass. >> how does this process work? because we tend to book our reservations through the airlines. somehow this gets to tsa, we're not sure how it works, but how much can you disclose about how much this process works to keep us safe. >> just a high level, is that however you book your reservation, travel agency or airline, they'll ask for the information and then they will send it to tsa and secure flight. they will do the watch list matching and then if the passenger is cleared, and by providing the information that

we ask for, more than 99% of passengers will be cleared. we'll send back the information to the airline to be able to issue a boarding pass. >> you've been on both sides of this issue. you had a long career with the airlines before working with tsa now. based on your experience on both levels, do you feel this is enough now to get us to a point where we are essentially safe in the skies? >> i absolutely do. i think there is enough information that we're asking for that will provide us the ability to do the clearing but i think more importantly it will be a consistent process. so as you go from carrier to carrier, regardless of who, it will be consistent across the spectrum. >> and we came into some examples of how this has work sod far as -- work sod far as far as the screening. but the continuing screeners are continuing to intercept things. just if the first week of august, what you see on your screen are a few of the things

intercepted. there has been arrested for suspicious behavior. dozens of firearms, concealed prohibited items and incidents that require closing or evacuations. so we could look at this in two ways, one that something is working in the fact we are able to intercept these, but two, people are still trying to circumvent the system in some way. so do we need to do something more? >> i think tsa has done a great job in looking at all of the different layers of security. secure flight is one of them. it's the latest one of them. i think tsa has done a great job in identifying what the laters -- the layers need to be and implementing the layers. >> and i think the majority of travelers may sea -- may say they're inconvenienced but they're fine with it to make sure they are safe. and the other question is as we continue to roll out programs like this as is safe as they may be, there is the question is what is next down the line, what do i have to do next?

will we be facing more changes down the road or give up more personal information? >> as far as the personal information, all of the tests that we've done suggests that this is all of the information we need in order for somebody to get a boarding pass. now it's hard to predict what the future will be. but in terms of secure flight and the ability it get a boarding pass and get cleared, this is all of the information that we need. >> and we all think when we are going through the security lines, is everything necessary we wonder. but one, a lot of people talk about is the liquids and that's been modified i guess. are we always going to be having to worry about having our liquids in a separate bag and being restricted as to what we can take through. >> that's probably not a question i can answer. i have a hard enough time getting secure flights available let alone worried about liquids. but the secure flight is the most important piece in the foreseeable future and i think that's the one focus we're focusing on in tsa that travels

to pop in color and spruce up the flowers. thomas, how are you today? >> very good, claudia. >> so it's not the end of the road for the plow flour -- the flowers and we still have time. >> absolutely. these are some great plants that will inoduce color into the late summer garden and whether you are a good gardener or not, it will make people think that you are. there are some good reasons. you want to fill in the plants this time of the year because a lot of spring annuals and perennials begin to die back. things like cone flowers or remember eckia are good for that. the crepe murdels are showing off. plants like grasses, miscantis, look at the blooms just coming into bloom. >> and if you put them in this time of year, it's already there for next year.

>> and not only that, as the garden starts to get a little bit peeked, you can introduce things like this for the spots bear and the reed grass adds some whimsey because it has the corkscrew looking reads, it's a hollow grass. and a lot of things about the late summer plants that they are brought tolerant. so once this becomes established, you're not adding water to this and you're going green. >> and this has a nice little touch of color. >> it has a very nice slight touch of color but more importantly, the other thing about some of the late summer plants are the foliage. because we've got things like the agewgaws which are just coming into their own. so you don't have to worry about the flowers of it all. if you want, you can add a splash of color through the foliage.
